1. Agreement to Our Legal Terms
We are Clear Showings LLC ("Company," "we," "us," "our"), a company registered in North Carolina, United States at 615 River Highway, Suite 1008, Mooresville, NC 28117, United States.
We operate the website https://www.clearshowings.com (the "Site"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").
Clear Showings provides a real estate safety platform designed to enhance agent security through identity and trust verification.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Clear Showings LLC, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
We will provide you with prior notice of any scheduled changes to the Services you are using. The modified Legal Terms will become effective upon posting or notifying you by contact@clearshowings.com, as stated in the email message. By continuing to use the Services after the effective date of any changes, you agree to be bound by the modified terms.
The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services.
We recommend that you print a copy of these Legal Terms for your records.
2. Our Services
The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.
The Services are not tailored to comply with industry-specific regulations (Health Insurance Portability and Accountability Act (HIPAA), Federal Information Security Management Act (FISMA), etc.), so if your interactions would be subjected to such laws, you may not use the Services. You may not use the Services in a way that would violate the Gramm-Leach-Bliley Act (GLBA).
3. Verification Services and Outputs
Service tiers. Clear Showings offers identity verification through two service tiers:
- Clear Show ID — identity document verification and automated face matching only. Clear Show ID sessions do not include watchlist, AML/PEP, deceased-records, or registry screening of any kind.
- Clear Show 360 — includes all Clear Show ID functionality plus: phone confirmation via one-time passcode; AML/PEP (anti-money-laundering, sanctions, and politically exposed person) watchlist screening; a United States deceased-records check; and, for identity documents issued by a supported country, Global ID Confirmation. Clear Show 360 does not include criminal-history or criminal/public-records screening of any kind.
Global ID Confirmation. Every identity document presented in a Clear Show 360 session receives document authentication (validation of the document's authenticity and security features, face matching, and liveness detection). For documents issued by a supported country, Clear Showings additionally validates the presented document against the issuing government's own registry, transmitting only the minimum data required to validate the presented document and operating within the verification consent presented to the data subject. Supported countries, the registries used, and the cross-border transfer this entails are described in our Privacy Policy. Documents from all other countries receive document authentication only, with no query to the issuing government.
Verification summary. Upon completion of a verification session, the requesting agent receives a verification
summary through the secure Clear Showings dashboard. For Clear Show ID sessions, the verification summary consists of: the data subject's name; face-match similarity and confidence scores; the selfie photograph captured during verification; the portrait extracted from the identity document; and PII-masked images of the identity document. For Clear Show 360 sessions, the verification summary additionally includes: the Assessment (Green, Yellow, or Red, delivered with the specific reason for its color) derived from the verification checks performed in the session; a yes/no AML/PEP watchlist match flag; the phone-confirmation completion status; the deceased-records check outcome; and, where Global ID Confirmation was performed, the registry-validation outcome. No biometric template, unmasked identity document image, or underlying screening record is displayed to or accessible by any user.
Nature of outputs. Verification outputs reflect automated processing of information available at the time of the session. Clear Showings does not guarantee the accuracy, completeness, or currency of any verification output, and a completed verification — including a passing face match, a Green Assessment, a negative AML/PEP result, or a successful registry validation — IS NOT A GUARANTEE OF ANY PERSON'S IDENTITY, CHARACTER, INTENTIONS, OR CONDUCT, AND IS NOT A GUARANTEE OF PERSONAL SAFETY. Verification is one informational input among many; users remain solely responsible for their own safety practices and decisions.
Agent decision-making. Clear Showings is not a consumer reporting agency and does not furnish consumer reports within the meaning of the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.). Clear Showings does not collect, process, or report criminal-history, credit, or tenant-screening information. No fully automated decision to deny property access is made by the Services; all determinations regarding property access are made solely by the requesting agent. Clear Showings does not make, recommend, or enforce any access decision.
4. Use of Verification Outputs
If you are a requesting agent or otherwise receive a verification summary through the Services, you agree that you will:
- use verification outputs solely for the purpose of deciding whether to proceed with a specific real estate showing, open house, or property tour;
- not use any verification output, in whole or in part, for any purpose governed by the Fair Credit Reporting Act, including decisions regarding employment, tenancy, credit, insurance, or eligibility for any benefit;
- not copy, screenshot, download, export, publish, post, share, or otherwise redistribute any verification summary or any component of it — including the data subject's selfie photograph, identity document images, face-match scores, Assessment, or AML/PEP flag — to any person or platform outside the secure Clear Showings dashboard;
- not retain any verification output beyond the retention periods described in our Privacy Policy;
- apply verification outputs uniformly and make all property-access determinations in compliance with the Fair Housing Act (42 U.S.C. § 3604) and all applicable state and local fair housing laws, without reference to race, color, religion, national origin, sex, familial status, disability, or any other protected characteristic; and
- promptly notify us at contact@clearshowings.com of any suspected unauthorized access to or disclosure of a verification summary.
Any violation of this Section 4 constitutes a material breach of these Legal Terms and may result in immediate suspension or termination of your account, in addition to any other remedy available to us. You are solely responsible and liable for any misuse of verification outputs by you or by anyone accessing the Services through your account.
5. Intellectual Property Rights
Our intellectual property
We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the "Content"), as well as the trademarks, service marks, and logos contained therein (the "Marks").
Our Content and Marks are protected by copyright and trademark laws (and various other intellectual property rights and unfair competition laws) and treaties in the United States and around the world.
The Content and Marks are provided in or through the Services "AS IS" for your personal, non-commercial use or internal business purpose only.
Your use of our Services
Subject to your compliance with these Legal Terms, including Section 10 ("PROHIBITED ACTIVITIES") below, we grant you a non-exclusive, non-transferable, revocable license to: access the Services; and download or print a copy of any portion of the Content to which you have properly gained access, solely for your personal, non-commercial use or internal business purpose. For the avoidance of doubt, this license does not extend to verification summaries or their components, whose use is governed exclusively by Section 4 ("USE OF VERIFICATION OUTPUTS").
Except as set out in this section or elsewhere in our Legal Terms, no part of the Services and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated,
transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
If you wish to make any use of the Services, Content, or Marks other than as set out in this section or elsewhere in our Legal Terms, please address your request to: contact@clearshowings.com. If we ever grant you the permission to post, reproduce, or publicly display any part of our Services or Content, you must identify us as the owners or licensors of the Services, Content, or Marks and ensure that any copyright or proprietary notice appears or is visible on posting, reproducing, or displaying our Content.
We reserve all rights not expressly granted to you in and to the Services, Content, and Marks.
Any breach of these Intellectual Property Rights will constitute a material breach of our Legal Terms and your right to use our Services will terminate immediately.
Your submissions
By directly sending us any question, comment, suggestion, idea, feedback, or other information about the Services ("Submissions"), you agree to assign to us all intellectual property rights in such Submission. You agree that we shall own this Submission and be entitled to its unrestricted use and dissemination for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.
You are responsible for what you post or upload: by sending us Submissions through any part of the Services you confirm that you have read and agree with Section 10 ("PROHIBITED ACTIVITIES") and will not post, send, publish, upload, or transmit through the Services any Submission that is illegal, harassing, hateful, harmful, defamatory, obscene, bullying, abusive, discriminatory, threatening to any person or group, sexually explicit, false, inaccurate, deceitful, or misleading; to the extent permissible by applicable law, waive any and all moral rights to any such Submission; warrant that any such Submission is original to you or that you have the necessary rights and licenses to submit such Submissions; and warrant that your Submissions do not constitute confidential information.
You are solely responsible for your Submissions and you expressly agree to reimburse us for any and all losses that we may suffer because of your breach of (a) this section, (b) any third party's intellectual property rights, or (c) applicable law.
6. User Representations
By using the Services, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Legal Terms; (4) you are not a minor in the jurisdiction in which you reside; (5) you will not access the Services through automated or non-human means, whether through a bot, script or otherwise; (6) you will not use the Services for any illegal or unauthorized purpose; and (7) your use of the Services will not violate any applicable law or regulation.
If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Services (or any portion thereof).
7. User Registration
You may be required to register to use the Services. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username
you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
8. Purchases and Payment
We accept Visa, Mastercard, American Express, and Discover, processed through our payment processor, Stripe.
You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in US dollars.
You agree to pay all charges at the prices then in effect for your purchases, and you authorize us to charge your chosen payment provider for any such amounts upon placing your order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.
We reserve the right to refuse any order placed through the Services. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.
9. Subscriptions, Verification Credits, and Refunds
Subscriptions. Some Services are offered on a recurring subscription basis. Where you purchase a subscription, you authorize recurring charges to your payment method at the then-current rates until you cancel. We will disclose the billing frequency and price before you subscribe. You may cancel at any time through your account or by contacting contact@clearshowings.com; cancellation takes effect at the end of the current billing period.
Verification credits. Some Services are offered as prepaid verification checks or credit pools, including pooled allocations under association or enterprise agreements. Unless otherwise stated in your order or a separate written agreement: credits are consumed when a verification session is initiated; unused credits do not roll over beyond the period stated at purchase; and credits have no cash value and are non-transferable.
Refunds. Except where required by applicable law or expressly stated in a separate written agreement, fees already paid — including subscription fees and prepaid verification credits — are non-refundable.
10. Prohibited Activities
You may not access or use the Services for any purpose other than that for which we make the Services available. As a user of the Services, you agree not to:
- systematically retrieve data to create a collection or database without our written permission;
- trick, defraud, or mislead us or other users;
- circumvent, disable, or interfere with security features;
- knowingly make materially false or defamatory statements concerning us or the Services, engage in unlawful threats, harassment, or fraud directed toward us or our personnel, or intentionally interfere with the operation or security of the Services;
- use information from the Services to harass, abuse, or harm another person;
- use, copy, or redistribute any verification summary or its components except as permitted in Section 4 ("USE OF VERIFICATION OUTPUTS");
- submit another person's identity document, photograph, or likeness in a verification session, or otherwise impersonate any person during verification;
- make improper use of our support services;
- engage in automated use of the system (scripts, bots, scrapers, data mining);
- attempt to impersonate another user;
- upload viruses or malicious code;
- interfere with or create an undue burden on the Services;
- harass our employees or agents;
- attempt to bypass access measures;
- copy or adapt the Services' software;
- reverse engineer the software except as permitted by law;
- collect usernames or email addresses for unsolicited email;
- use the Services to compete with us;
- advertise or sell goods and services through the Services; or
- sell or transfer your profile.
11. Services Management
We reserve the right, but not the obligation, to: monitor the Services for violations of these Legal Terms; take appropriate legal action against anyone who violates the law or these Legal Terms; refuse, restrict, or disable any of your contributions; remove content that is excessive or burdensome to our systems; and otherwise manage the Services to protect our rights and property and to facilitate the proper functioning of the Services.
12. Privacy Policy
We care about data privacy and security. Please review our Privacy Policy: https://www.clearshowings.com/policy. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms. The Services and information processed through the Services may be hosted, accessed, transferred, or processed in the United States, the European Economic Area, and other jurisdictions described in our Privacy Policy and Data Processing Addendum. Where required by applicable law, Clear Showings will use an appropriate data-transfer mechanism and other applicable safeguards.
13. Copyright Infringements
We respect the intellectual property rights of others. If you believe that any material available on or through the Services infringes a copyright you own or control, please notify us using the contact information below. Please be advised that under applicable law you may be held liable for damages if you make material misrepresentations in such a notification.
14. Term and Termination
These Legal Terms remain in full force and effect while you use the Services. WITHOUT LIMITING ANY OTHER PROVISION OF THESE LEGAL TERMS, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND
WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SERVICES TO ANY PERSON FOR ANY REASON. We may terminate your use or participation in the Services or delete your account at any time, without warning, in our sole discretion.
If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party.
15. Modifications and Interruptions
We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice. We cannot guarantee the Services will be available at all times and will not be liable for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime or discontinuance.
16. Governing Law
These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of the State of North Carolina applicable to agreements made and to be entirely performed within the State of North Carolina, without regard to its conflict of law principles.
17. Dispute Resolution
Informal Negotiations
To expedite resolution and control the cost of any dispute, controversy, or claim related to these Legal Terms (each a "Dispute"), the Parties agree to first attempt to negotiate any Dispute (except those expressly excluded below) informally for at least thirty (30) days before initiating arbitration.
Binding Arbitration
If the Parties are unable to resolve a Dispute through informal negotiations, the Dispute (except those excluded below) will be finally and exclusively resolved by binding arbitration. YOU UNDERSTAND THAT WITHOUT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL. The arbitration shall be conducted under the Commercial Arbitration Rules of the American Arbitration Association ("AAA") and, where appropriate, the AAA's Supplementary Procedures for Consumer Related Disputes. Except where otherwise required, the arbitration will take place in Iredell County, North Carolina.
If for any reason a Dispute proceeds in court rather than arbitration, the Dispute shall be commenced or prosecuted in the state and federal courts located in Iredell County, North Carolina, and the Parties consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in such courts.
In no event shall any Dispute brought by either Party related in any way to the Services be commenced more than one (1) year after the cause of action arose.
Restrictions
Any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law,
(a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be
arbitrated on a class-action basis; and (c) there is no right or authority for any Dispute to be brought in a representative capacity on behalf of the general public.
Exceptions
The following Disputes are not subject to the above provisions concerning informal negotiations and binding arbitration: (a) Disputes seeking to enforce or protect, or concerning the validity of, intellectual property rights; (b) Disputes related to allegations of theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief.
18. Corrections
There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information at any time, without prior notice.
19. Disclaimer
THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT AND ASSUME NO LIABILITY FOR ANY ERRORS OR INACCURACIES OF CONTENT, PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR ACCESS TO AND USE OF THE SERVICES, ANY UNAUTHORIZED ACCESS TO OUR SERVERS, OR ANY INTERRUPTION OF TRANSMISSION TO OR FROM THE SERVICES.
WITHOUT LIMITING THE FOREGOING, WE MAKE NO WARRANTY THAT ANY VERIFICATION OUTPUT — INCLUDING A PASSING FACE MATCH, A GREEN ASSESSMENT, A NEGATIVE AML/PEP RESULT, OR A SUCCESSFUL REGISTRY VALIDATION — ACCURATELY REFLECTS ANY PERSON'S IDENTITY, HISTORY, CHARACTER, OR INTENTIONS, AND WE DISCLAIM ALL LIABILITY FOR ANY INJURY, LOSS, OR DAMAGE ARISING FROM RELIANCE ON ANY VERIFICATION OUTPUT OR FROM ANY IN-PERSON INTERACTION, SHOWING, OR PROPERTY TOUR, WHETHER OR NOT A VERIFICATION SESSION WAS COMPLETED.
20. Limitations of Liability
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE TWELVE (12) MONTH PERIOD PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.
NOTWITHSTANDING THE FOREGOING, THE PARTIES MAY AGREE IN AN APPLICABLE ORDER FORM OR ENTERPRISE AGREEMENT TO A SEPARATE OR HIGHER LIABILITY CAP FOR CLAIMS ARISING FROM A BREACH OF CONFIDENTIALITY, A SECURITY INCIDENT, OR A VIOLATION OF APPLICABLE PRIVACY OR DATA-PROTECTION LAW. NOTHING IN THESE LEGAL TERMS LIMITS LIABILITY TO THE EXTENT SUCH LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY ARISING FROM FRAUD, WILLFUL MISCONDUCT, OR THE UNLAWFUL USE OR DISCLOSURE OF PERSONAL OR BIOMETRIC DATA.
21. Indemnification
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your unlawful or unauthorized use of the Services; (2) breach of these Legal Terms; (3) any breach of your representations and warranties; (4) your violation of the rights of a third party; (5) your use or misuse of any verification output, including any violation of Section 4 ("USE OF VERIFICATION OUTPUTS"); or (6) any overt harmful act toward any other user of the Services. Your indemnification obligations will apply only to the extent the applicable claim, loss, damage, liability, or expense was caused by your acts or omissions and will not apply to the extent caused by Clear Showings' breach of these Legal Terms, negligence, willful misconduct, unlawful processing of personal information, or violation of applicable privacy or data-protection law.
22. User Data
We will maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services, as well as data relating to your use of the Services. Although we perform regular routine backups, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services.
23. Electronic Communications, Transactions, and Signatures
Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communication be in writing. YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS, AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS OF TRANSACTIONS.
24. California Users and Residents
If any complaint with us is not satisfactorily resolved, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834 or by telephone at (800) 952-5210 or (916) 445-1254.
25. Miscellaneous
These Legal Terms and any policies or operating rules posted by us constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision shall not operate as a waiver. We may assign any or all of our rights and obligations to others at any time. If any provision or part of a provision of these Legal Terms is determined to be unlawful, void, or unenforceable, that provision is deemed severable and does not affect the validity of any remaining provisions. There is no joint venture, partnership, employment, or agency relationship created between you and us as a result of these Legal Terms. Order of Precedence. If there is a conflict among the documents governing the Services, the following order of precedence applies: (1) an executed Order Form or separately negotiated written agreement, but only with respect to the subject matter expressly addressed therein; (2) the Data Processing Addendum with respect to the processing and protection of personal information; (3) the Biometric Data Policy with respect to the collection, use, disclosure, retention, and destruction of biometric data; (4) the Privacy Policy with respect to Clear Showings’ general privacy practices; and (5) these Terms and Conditions. A more specific provision addressing a particular subject controls over a more general provision concerning the same subject.Survival. Any provisions that by their nature are intended to survive termination or expiration of these Legal Terms will survive, including provisions concerning intellectual property rights, restrictions on use of verification outputs, disclaimers, limitations of liability, indemnification, dispute resolution, and obligations concerning the confidentiality, retention, deletion, or protection of information.
